Terms of Purchase Agreement for Malak Ouza LLC

These below are all just items most put in place for legality matters. I have never had any  matters, nor do I ever anticipate any. Always remember I got your back to the best of my abilities and just come with an open heart and mind, trusting to get exactly what you need!! 

Please read ALL these terms carefully as they are a binding legal contract for all of companies services and/or products , and we suggest saving this as a copy for your records. 

Some programs or services have separate sections that apply just to that section, however  the rest of the terms and conditions applies to all programs and services.

You are purchasing access to the agreed upon program discussed( such as the 6 week , 3 or  6 month program ,courses, empowered travelers guide , 1:1 sessions and/or any programs/services , self growth events , etc purchased from Malak Ouza.

1:1 Services

For all other services and/or products purchased from company:

• Start date is the day agreed upon.
• You are paying for this in USD and either in full or installments. You are purchasing this in your business capacity and guaranteeing the purchase as an individual.
• These Terms of Purchase & Community Guidelines listed below are the entire agreement between us. This Terms of Purchase supersede our prior discussions, emails, online or voice messages. 
• I am required by law to say that my readings are for entertainment purpose only. Disclaimer - All readings are simply meant to be taken as guidance. I am not responsible for any choices or decisions you make as a result of my readings and/or guidance and/or consulting services. 
• It is vital to understand that company will do its best to protect privacy of client, however as with any company, there may be breech of confidentiality if there are hackers. That has never been the case, however it is vital to understand that within ANY company, hackers are a possibility. 
• There will be no coaching done through instagram , Facebook, direct messages, emails or any other Chanel not within the program Chanels listed on the sales page such as the Facebook group for this program. 
• No refunds!!!

Virtual Coaching Programs

This is a  virtual meetup as discussed on the sales page for this program and it may include content such as designated  topics of discussion, FAQ’s coaching calls, references, etc. The live videos may be repurposed for future programs. 

What happens after you pay:

Our secure payment processor is paypal. You should receive a receipt from paypal for your records shortly after purchase and your credit card statement should  say: Malak Ouza. 

Refunds:

Any services and/or products purchased from this company have a no refund policy.

Payment Schedule:

If you are paying in full, you will be charged one time on the date of your purchase.

If you are paying in installments( if that is an option for your service or program), your card will be charged a number of times beginning your first payment , and then every month as stated in the third party party such as stripe or paypal thereafter until paid in full( this Is if you are sent an invoice). However, if you are not sent an invoice and are told to remind yourself, then you are responsible for paying as advised on the sales page. 

By completing this purchase, you acknowledge, agree, and authorize us to charge your card on a recurring basis on these dates.

Please note if you are paying in installments: This program and/or course is an “all or nothing” purchase. If your card account is declined for any reason (insufficient credit, closed, expired, or other reason), we will contact you to update your payment information. You agree to do so within 5 business days. Failure to update your account information will cause your access to the program to be suspended entirely. You will no longer have access to any  content. This is not a pay by month, or pay for partial access, situation, which would not be fair to those who have committed to the entire payment plan.

If payment is not received , we have the right to go collect payment from your credit card company and take it through credit card collection. If  payment is not received by the agreed  upon time , we have a right to  revoke your  access ASAP to the program/service  and any content including access to any support groups.

By purchasing this event, you agree to these terms and conditions!  No refunds. No one has requested a refund prior and none are anticipated because this is truly something I wish I had had when I  first started my journey. If there is any unforeseen changes, a new date will be assigned for the event.  By purchasing this and/or using any of the affiliates on this website,/in this guide, you understand & agree that these are tips and my personal experience. Licenses for these items are available for purchase, starting at $50,000 USD. If you choose to take these actions, you will be notified and billed accordingly.

NON-DISPARAGEMENT:

You shall not make any false, disparaging, or derogatory statement in public or private regarding Company, its employees, or agents. Company shall not make any false, disparaging, or derogatory statements in public or private regarding Client and its relationship with Company.

INDEMNIFICATION:

THIS SITE AND COURSE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY SITE-RELATED SERVICE, IS PROVIDED “AS IS,” WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. PHYSICAL AND MENTAL HEALTH REQUIREMENTS:

By signing up for the course, you attest that you are in good physical and mental health to travel and participate in the course. You are advised to consult with a physician to ensure you are inadequate health. 

 RELEASE OF LIABILITY / ASSUMPTION OF RISK. You agree to the following:

•  Certain activities including, but not limited to any activity recommendations such as yoga, swimming, hiking, running have risks of injury, including serious injury. You understand the nature of the activity and acknowledge that you are qualified, in good health, and in proper physical condition to participate in such activity. You further agree and warrant that if, at any time, you believe the conditions to be unsafe, you will immediately discontinue further participation in the activity.
• You will notify the Company if you suffer from any medical or health condition that may cause injury to yourself or others or may require emergency care during your participation.
•   YOU KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS and dangers, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (as defined below) or others, and assume full responsibility for your participation. You acknowledge that these risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the course, the conditions in which the course takes place, of the negligence of Company. YOU FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES you incur as a result of your participation in the course.
• YOU HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Company, its sponsors, employees, sta , volunteers, other participants, owners and lessees of the premises on which the Activity is conducted (“Releasees”) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON YOUR ACCOUNT CAUSED, OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; and you further agree that if, despite this Agreement, you, or anyone on your behalf makes a claim against any of the Releases, you WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may be incurred as the result of such claim

 MEDIA RELEASE:

Company reserves the right to use photos or videos for promotional purposes. By signing up, you agree to allow your image or voice to be used for this purpose. If you do not want your image or voice to be used, please notify the Company in writing before the program begins.

MSC:

-Group Coaching calls may be recorded and might be repurposed for other company uses, not limited to this however such as future courses/guides, etc. Furthermore, feedback/comments in private facebook support groups,and/or feedback about companies programs via private message may be repurposed and used on companies social media accounts and future programs.

-Recordings for programs are meant to be accessed for lifetime, however company is not responsible if the vendors we use ( such as zoom, youtube, facebook, or any other company)  are no longer in business and/or change their policies which may alter the recordings and deny us access to them. We do not foresee this occurring, however it is a disclaimer for a possibility. 

-You understand dates and arrival of content material are subject to change if any unforeseen difficulties arise such as sickness, deaths, world crisis, pandemics, or any event that causes changes to the program purchased from the company.

-When joining any group program such as group coaching or  courses, the client understands it means that there may be other people eventually and not necessarily from the official launch date. 

-Malak Ouza and company  can not and does not make any guarantees about your ability to get results or earn any money, heal, manifest, etc  with our ideas, information, tools, or strategies for any of the programs  or services including 1:1 services.

-Nothing on this page, any of our websites, or any of our social media pages, content or curriculum, contacts, resources, etc is a promise or guarantee of results or future earnings, and we do not offer any legal, medical, tax or other professional advice. Any financial numbers referenced here, or on any of our sites, are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance. Use caution and always consult your accountant, lawyer or professional advisor before acting on this or any information related to a lifestyle change or your business or finances.
